THE STATE OF INFORMED CONSENT IN ADHD

by Fred A. Baughman Jr., MD

El Cajon, CA 92019

The first element of informed consent, is the physicians telling the
patient (parents) all that is material…pertinent about the condition
to be treated–most importantly, whether it is an actual disease or not.
Nowadays, virtually all parents are told that ADHD, and all psychiatric,
emotional, and behavioral problems are diseases, when none of them are.
Such a lie, leading patients (parents) to believe they have a disease;
an abnormality, when they are physically normal denies them informed
consent and makes an assault and battery of any treatment rendered
pursuant to such a lie.

On December 24, 1994, Paul Leber, of the Food and Drug Administration
(federal) wrote to me: “…as yet no distinctive pathophysiology for the
disorder has been delineated.”

On October 25, 1995, Gene R. Haislip of the Drug Enforcement
Administration (federal) wrote to me: “We are also unaware that ADHD has
been validated as a biologic/organic syndrome or disease.”
In May 13, 1998, F. Xavier Castellanos, of the National Institute of
Mental Health (federal) wrote me: “I agree we have not yet met the
burden of demonstrating the specific pathophysiology that we believe
underlies this condition.”

Speaking at the November 16-18, 1998, National Institutes of Health,
Consensus Conference on ADHD, William B. Carey concluded: “What is now
most often described as ADHD in the United States appears to be a set of
normal behavioral variations… This discrepancy leaves the validity of
the construct (ADHD) in doubt…”

With no proof with which to counter Carey’s assertion, the final
statement of Consensus Conference Panel (11/18/98) read (p.3, lines
10-13): “…we do not have an independent, valid test for ADHD, and
there are no data to indicate that ADHD is due to a brain malfunction.”

In the January, 2000, Readers Digest, with five million US children thus
labeled and drugged, Castellanos (NIMH) confessed: “Incontrovertible
evidence is still lacking…”

The second element of informed consent is the physicians relating to the
patient (parents) all that is material…pertinent, about such
treatments as are available for the condition in question.

Regarding drug treatment for ADHD, the October, 1995, Drug Enforcement
Administration, Background Paper on Methylphenidate (Ritalin) had this
to say (page 4): “Whereas the majority of children experience only minor
side effects under medically supervised controlled conditions, there are
a significant number of case reports documenting more severe abuse.
These reports and scientific studies of abuse potential are routinely
down-played, if referenced at all. As a consequence, parents of children
and adult patients are not being provided with the opportunity for
informed consent…”

Those who maintain that mental health patients are accorded full,
honest, informed consent, could not be more mistaken.

In a “special advertising feature” in the November 20, 2001, Family
Circle magazine, Richard K. Harding, President of the American
Psychiatric Association (APA), wrote: “We now know that mental
illnesses–such as depression or schizophrenia–are not “moral
weaknesses” or “imagined” but real diseases caused by abnormalities of
brain structure and imbalances of chemicals in the brain.”

Harding, the leader of all US organized psychiatry, lies. He knows there
is no abnormality of the brain as is necessary to say they have
diagnosed a disease.

In the first-ever Surgeon General’s report on mental health, in
December, 1999, Satcher, declared: “Mental illness is no different than
diabetes, asthma or other physical ailments … Mental illnesses are
physical illnesses, evidenced by changes in brain chemicals and other
physical causes…”

Satcher–our # 1 federal physician, lies.

Claims such as these, and such as are posited daily by organized
psychiatry, are in violation of California, SB-836 (now law), Figueroa,
under which: “…It is unlawful for any person licensed in the healing
arts to disseminate or cause to be disseminated any form of public
communication, as defined, containing a false, fraudulent, misleading,
or deceptive statement or claim…”

There is no doubt of the conspiracy to drug US children. The
conspirators are (1) Big Pharma (the world-wide pharmaceutical industry)
that funds it all, (2) psychiatry, and all of US academic and organized
medicine, and (3) the US federal government–most importantly, the
Congress with more than one lobbyist/Congressman, and the US Department
of Education–front-line “pusher” and “enforcer,” drunk with power.

The lynch-pin of the fraud is to represent all psychiatric
diagnoses/conditions to be “brain diseases” due to “chemical imbalances
of the brain,” needing “chemical balancers”–pills. In fact, all of the
children are normal.
